To assist you in using the Website and associated services, and to ensure a clear understanding of the relationship arising from your use of the Website and participation in these Services, we have created (i) these Terms of Use (the "Terms") and (ii) a Privacy Policy. The terms "Florida Rental Agency, LLC" "we" and "us" and "the site" refer to Florida Rental Agency, LLC.

You should read through all the Terms carefully. The Terms constitute a legally binding agreement between you and FlaRBO. You are not authorized to use this Site unless you are at least 18 years of age and able to enter into legally binding contracts.

1. The Site is an Advertising Venue and We are Not a Party to any Rental Agreement or other Transaction Between Users of the Site.

Travelers and Hosts

We urge all users to be responsible about their use of this Site and any transaction entered into as a result of either listing a property or renting a property. We do not own or manage, nor can we contract for, any vacation rental property listed on a Site. FlaRBO acts as an advertising venue to allow homeowners, hosts and property managers who advertise on the Site (each, a "member") to offer for rent in a variety of pricing formats, a specific vacation or short-term rental property to potential renters or renters (each, a "traveler" and, collectively with a member). "Members" may also include property owners, hosts or managers who originally advertised their properties on another website and their listings have been redistributed on the Site. We also may offer online bookings or other tools or services to allow users to communicate with each other and enter into rental agreements or other transactions.

Booking Contracts

Florida Rental Agency, LLC is not a party to any rental or other agreement between traveler and host. This is true even if the Site allows you to book a rental or provides other ancillary products or services, as the Site may facilitate booking a rental or other tool, services or products, but we are not a party to any rental or other agreement between users.

As a result, any part of any actual or potential transaction between a traveler and a member, including the quality, condition, safety or legality of the properties advertised, the truth or accuracy of the listings (including the content thereof or any review relating to any property), the ability of members to rent a vacation property or the ability of travelers to contract for properties are solely the responsibility of each user. You acknowledge and agree that you may be required to enter into one or more separate agreements, waivers or terms and conditions prior to making a booking or purchasing a product or service and may place additional restrictions on your booking, product or service.

Responsibility for applicable laws, rules, and regulations: Users agree that they are responsible for, and agree to abide by, all laws, rules, and regulations applicable to their use of the Site, their use of any tool, service or product offered on the Site and any transaction they enter into on the Site or in connection with their use of the Site.

Host Responsibilities

Members further agree that they are responsible for and agree to abide by all laws, rules and regulations applicable to the listing of their rental property and the conduct of their rental business, including but not limited to any and all state laws, rules, regulations or other requirements relating to taxes, credit cards, data and privacy, taxes, permits or license requirements, zoning ordinances, vacation ordinances, safety compliance and compliance with all anti-discrimination and fair housing laws, as applicable. Please be aware that, even though we are not a party to any rental transaction and assume no liability for legal or regulatory compliance pertaining to rental properties listed on the Site, there may be circumstances where we are nevertheless legally obligated (as we may determine in our sole discretion) to provide information relating to your listing in order to comply with governmental bodies in relation to investigations, litigation or administrative proceedings, and we may choose to comply with or disregard such obligation in our sole discretion. Members who accept credit card, banking or other payment information from travelers agree to properly handle and safeguard all such information in accordance with applicable legal and regulatory requirements and best practices.

Host Listing Responsibilities

Florida Rental Agency, LLC offers hosts the right to advertise and use the Florida Rental Agency, LLC site to rent their short term rental properties with our traveler community while earning money. It is easy to create a listing and hosts are in control and responsible for setting prices, rules, policies and keeping their calendars up to date.

The Host's listing must include complete and accurate information about your Host service, your price, other charges like cleaning fees, resort fees, offline fees, and any rules or requirements that apply to your Guests or Listing. Hosts are responsible for keeping their Listing information (including calendar availability) and content (like photos) up to date and accurate at all times.

We recommend that you obtain appropriate insurance for your Host Services and suggest you carefully review policy terms and conditions including coverage details and exclusions. You may only maintain one listing per property unit.

Contracting with Guests

When a Host accepts a booking request through the Florida Rental Agency, LLC Site, the Host is entering into a contract directly with the Guest, and is responsible for delivering your Host Service under the terms and at the price specified in your Listing. Further if a host provides a supplemental rental contract to the Guest you are bound under the terms within that rental contract. Note:Any terms, policies or conditions that you include in any Guest supplemental contract must: (i) be consistent with these Terms, and the information provided in your Listing, and (ii) be prominently disclosed in your Listing description.

Host - Assumption of Risk

Hosts acknowledge that advertising and renting properties carries inherent risks and agree that you, the host, assumes the entire risk arising out of your access to and use of the Florida Rental Agency, LLC, offering Host services, or any interaction you have with other Members whether in person or online. You agree that you have had the opportunity to investigate the Florida Rental By Owners website and any laws, rules, regulations, or obligations that may be applicable to your property listings or Host services and that you are not relying upon any statement of law made by Florida Rental By Owners.

Cancelations and Traveler Issues

Hosts and Guests are responsible for any Booking Modifications they agree to make, and agree to pay any additional amounts, fees, or taxes associated with a Booking Modification.

If a Guest cancels a Reservation, the amount paid to the Guest is determined by the cancellation policy that applies to that Reservation in the Property Listing and/or Supplemental Host Rental Contract. As a Host, you should not cancel on a Guest without a valid reason or applicable law. If you cancel on a Guest without such a valid reason, we may impose consequences to your Florida Rental By Owners membership; including suspension or termination or subscription.

Host Taxes

Hosts are responsible for fulfilling tax obligations under applicable Florida laws. Including reporting county and state taxes, collecting, remitting, or include in your price any applicable VAT or other indirect taxes, such as occupancy, tourist, income taxes.

Reporting Violations

If you believe that a Member (Host or Traveler), Property Listing or Content poses an imminent risk of harm to a person or property, you should immediately contact local authorities before contacting Florida Rental Agency, LLC. In addition, if you believe that a Member, Property Listing or Content has violated terms, you should report your concerns to Florida Rental Agency, LLC. If you reported an issue to local authorities, Florida Rental By Owners may request a copy of that report. Except as required by law, you agree that we are not obligated to take action in response to any report.

Warnings of Suspicious Activity: While we do take certain measures with the goal to assist users to avoid potentially fraudulent or other illegal activity of which we become aware, we assume no liability or obligation to take any such measures or actions. When we provide warnings or messages to users about any such activity, we do not warrant that such messages are accurate or that such messages will reach any or all users they should have reached in a timely manner or at all or that such messages or measures will prevent any harm or otherwise have any impact

Member Violations

If a User breaches these Terms, Policies, or our Standards or violate applicable laws, regulations, or third-party rights, or Florida Rental Agency, LLC believes it is reasonably necessary to protect Florida Rental By Owners, its Members, or third parties; Florida Rental Agency, LLC may, with or without prior notice:

suspend or limit your access to or use of the Florida Rental By Owners Website and/or your Florida Rental Agency, LLC account

suspend or remove Property Listings, Reviews, or other Content

suspend or revoke any special status associated with your account

For other minor violations or where otherwise appropriate as Florida Rental Agency, LLC will determine in its sole discretion, you will be given notice of any intended measure by Florida Rental Agency, LLC and an opportunity to resolve the issue. You may appeal actions taken by us under this section by contacting Florida Rental Agency, LLC customer service.

Where your data is sent

Data will not be shared with third parties for marketing or promotional purposes.
